When Pollution Becomes
An Issue

Port authorities and shipping administrations are regularly confronted with damages to port installations and the environment (pollution), however, their legal abilities are often restricted to immediate local action. However, damages are sometimes only detected when the guilty ship left the jurisdiction already.

As the claim amounts may sometimes be quite large, quick action is necessary to enforce adequate security before the ship’s registered owner or manager have been changed for them to evade liability.

Quick action would mean to evaluate the ship’s worldwide trading pattern in order to find a good arrest place and/or to search for other assets such as bank accounts that may be subject to a freezing order.
