Justitia Is Three-fold

Justitia is three-fold:

  1. You must be right (that’s your personal expertise)
  2. You must get right (you must convince the arbitrators or judge of your opinion)
  3. You must enforce your right (often a quite difficult task in international business)

There are a number of multinational or bi-national treaties and conventions that may facilitate an easy enforcement of foreign arbitration awards or court decisions.

An important tool hereto may be the tracing and supervision of third party assets which may be found in countries where an enforcement may be easier than in the country where the debtor has his principle place of business.
